Question How are system/account bans administered?

Two questions about getting banned:

1. If a system is RGH'd and connected to Xbox Live for >1 minute, without LiveBlock enabled - is a ban inevitable? (Does your Xbox end up on a list immediately, that results in an inevitable ban?)

2. If you go online with a stealth server but don't do anything other than sit at the official Xbox 360 Dashboard - is a ban inevitable? (Does your Xbox end up on a list immediately, that results in an inevitable ban: Hours, weeks, months, or years later?)

Both of these cases assume that after these "events" occur, the Xbox 360 is never taken online again.

I know these are odd questions that hold little base in reality, but an answer would be very helpful!

1) If you connect to live with a chipped Xbox, you're banned immediately upon connection being established.

2) No, you're usually banned as soon as they detect the modified hypervisor that's running or with a large volume of reports against the account, they'll usually issue a ban. There is no "list" you go on as far as I'm aware. You either get flagged via mass reports or banned upon detection of unsigned code/modified hypervisor.

Trust me when I say people DO report you if you hack in public matches. Regardless of you giving me XP, or giving me stats, whether you're using aim bot, or just a harmless name mod- I am one of the ones who will report you. People don't enjoy hackers in their public matches, so one way to avoid quick bans is to stay out of public matches.

If you connect to xbox live AT ALL on a modded xbox it will get banned. More or less immediately. I'm not an expert on how it detects the connection, but basically Microsoft waits for certain messages from the xbox that are used to determine if the console is modded.

To my limited understanding, a good stealth server intercepts those messages and fixes them so Microsoft can't detect that the xbox is modded. So, on a GOOD stealth server, you don't risk a whole lot just sitting on the dashboard (with mods there is always a chance, however small). However a poorly setup server will miss some of these messages and your chance of a ban skyrockets.

TL DR:
Without a stealth server = instant ban
With a good stealth server = VERY low chance of ban (on dashboard)
With a bad stealth server = Eventual ban.

Thanks, both for your responses. So then my final question relates to what "Connecting to Xbox Live" means. Is this "Connecting to Xbox Live"?

Anything that communicates with Xbox Live servers would be connecting to LIVE

Why do you think was I not notified of an instant-ban immediately after running the network test?
Did you allow it to communicate with Xbox Live? If it never reached the "internet --> Xbox Live" step, I don't think it communicates with their servers.

Yes, the entire test completed with success.
No idea why, maybe the packets that your Xbox uses to send test connections are unaffected by a modified console.

As soon as you press "Connect to Xbox Live" on the dashboard and connect, you are instantly banned. And I mean instantly. Like before it finishes loading, you're banned. This is me speaking from experience.

EDIT: When I say the packets that are used for test connections, I mean that a test connection most likely won't establish an open connection. It will send a few packets of test data to the server, and the server will send a few test packets back. If the Xbox receives those confirmation packets from the server saying "Hey, I got those!", then it says you are able to connect to Xbox Live servers.

This is all hypothetical though, I do not know how the Xbox test connection feature works. If you weren't immediately banned, I'd assume this to be the case though.

Either you got lucky, or that wasn't enough. I would still avoid anything that connects to the server in the future. Just to be safe.
Right, I also killed the internet connection within 30 seconds of the test completing so maybe it is banned I just didn't leave it on long enough for the ban to hit the system and there's a pending ban awaiting the systems return to the internet. No real safe way to find out, I guess. Would never do what I did on purpose, was just an ignorant mistake on my end. All my systems are used in LAN and don't actually touch LIVE anyway. Also, was this always the case? I had a PHAT JTAG back in 2010 (Hosting MW2 Lobbies in my youth) and remember I could go 2-3 hours on Xbox live with a fresh KV. Has something changed in how detection works?

Yes, Microsoft's detection has improved drastically. If you tried to sign into a live account that's an instant ban. As Rengar Rengar said, the test packets likely don't test if the console is modded. But signing it or trying to play a game definitely do.

If your console connects to live without something covering the challenges, your console will be flagged. When it gets banned is an entirely different story.

Yes and no. From what I understand, your console would not "know" it's banned until it sends the challenge again. If it doesn't do anything that requires it to send the challenge, you could technically never get banned. As for when you get flagged when connecting with a bypass, it would depend on how dirty the response is. If you have 10 people sending the same dirty response, you'll last a lot longer than 300 people sending that same dirty response. NiNJA has thousands of users (active and inactive) that have been using the same KV for over 2 years and are not banned yet. This is because of a good response, and proper counter measures for all sorts of checks done to see if your console is "legit". Some people still get banned quick, though. Because they don't keep a low profile.

Edit: Someone like TEIR1plus2 can probably give some more specifics. Or Dwack if he's alive.

Do you know if running a Network Test is considered enough to be connected to LIVE and flag the console?

No idea. It probably does communicate with XBL normally during the XBL portion of the test, but whether or not a console that is not connected to some sort of server sends any data to XBL before it fails the test is beyond what I know.
