You always have a risk of being banned

If it's done right, you realistically have a minimal chance of being banned

And it would be fine to play a burnt copy of Halo2, as long as it was properly patched

If you use a Kreon drive and rip your games, you will have to patch them to make them safe. I don't do this, so I have no idea how to do it

If you download games that have the work done for you, all you have to do is check them using a program. There are several tutorials on the site explaining how to check downloaded games

If the games aren't properly patched, your console could get banned from Xbox Live
