What blaze said, also there is no such thing as a 'ban wave'.

October-November 2009
That was a long time back, a major amount of the CoD community have been in an XP lobby or Challenge lobby and banning them is just going to cause Infinity Ward to have a high amount of haters. FaZe and Dare members as example have been in them many of times.

10th prestige modification on JTAG's wasn't found till January 2010 and MW2 came out on November 2009

That is when they started banning for flashed consoles.
Exactly so, would Microsoft cause a banwave for all the flashed consoles, as there a major games comoing out or have come out this year

There was a ban wave around MW2 but remember the outrage at the amount of banned consoles? There were at least 600,000 according multiple news posts and that was the lowest common number. MS got a lot of good and bad publicity for it, not sure they would want to drive customers away all over again.

Modded lobbies were around at the end of november/start of december 2009 actually. Hardly anyone knew about them but they existed. The time Call of Duty games are released is the perfect time to start a ban wave, people will buy a new console to play on MW3 online or will get a new console for christmas. If they'd done a ban wave around the Gears 3 release date they wouldn't have had anything to gain.
