Halo 2 mod disc on 360. Xbox live ban Question.

Hi.

Ive been looking around for an answer/explaination for this question for a while and haven't found a definate answer.

If i have a 360 with the modded firmware to load all media. Which is undetectable on xbox live. And I use a halo 2 modded disc. Can is auto ban? Because the xbox 360 believes its a legit disc it cant be detected right? Obviously feed back will eventually get you banned. In the case of a ban for hacking on the 360 is it the gamer tag or box that is banned? o both?

Obviously on original xbox you require a mod of some kind to load the disc which is detectable so i was wondering how this works differently on the 360.
